Former President Trump is seeking to dismiss a lawsuit filed against him and two others by Sandra Garza, the longtime partner of fallen U.S. Capitol Police officer Brian Sicknick, per Law 360
Why it matters: The move that comes after Trump’s historic indictment and ahead of his looming arrest this week is just one of several legal challenges the leading 2024 Republican presidential candidate is facing.
“WITCH HUNT,” the Republican wrote on his Truth Social platform shortly before travelling from his home in Florida to New York on Monday – a journey which drew blanket coverage across the US news channels.
On Tuesday morning, dozens of police and court officers as well as Secret Service agents are expected to escort Mr Trump through the streets of New York to the Lower Manhattan court complex.
The charges he faces will be disclosed in full at the hearing, which is scheduled for around 14:15 local time (19:15 BST). His lawyers have already said he will plead not guilty.
The former president is expected first to surrender at the office of Manhattan district attorney Alvin Bragg. He will then be arraigned in court – meaning the charges will be read out, and he will plead.
That’s because the ex-president – the first to face criminal charges – also appears to face serious problems in a potentially more perilous case involving his alleged mishandling of secret documents being investigated by special counsel Jack Smith. Charges look like an increasing possibility as the Justice Department secures evidence about Trump’s handling of classified documents after leaving the White House.
Smith’s prosecutors have secured daily notes, texts, emails and photographs and are focused on cataloguing how Trump handled classified records around Mar-a-Lago and those who may have witnessed the former president with them, Katelyn Polantz and Evan Perez reported Monday. The new details coincide with signs the Justice Department is taking steps consistent with the end of an investigation.
Will one of the charges against Trump be a felony?
In New York, fraud can be a felony if the lie was made with the intent to conceal or commit another crime. Sources close to the case have told US media that they believe at least one of the charges against Mr Trump could be a felony.
What could that be? Most signs point to breaking campaign finance rules – Mr Cohen has already been convicted for breaking campaign finance rules and tax evasion in connection to the payment.
What’s this case about?
The grand jury spent weeks investigating money paid during Trump’s 2016 presidential campaign to two women who alleged that they had extramarital sexual encounters with him. Trump has denied the allegations.
Trump’s former lawyer Michael Cohen, who testified as a key prosecution witness, paid adult film actor Stephanie Clifford, known as Stormy Daniels, $130,000 through a shell company he set up and was then reimbursed by Trump, whose company logged the reimbursements as legal expenses.

An indictment is the formal charge brought against someone after a grand jury — which is made up of members of the community — votes and enough members agree there’s sufficient evidence to charge someone with a crime.
The indictment against Trump remains sealed, as is standard in New York before an arraignment.
